    Terms of Use

    1. Terms and definitions

    1.1. “Site” - the website on the Internet located at https://hill.uz, including all of its subdomains and sections, which serves as the platform for distributing the electronic version of HILL magazine (registration number as a mass medium in the territory of the Republic of Uzbekistan - 577110, issued by the Inspectorate for Control in the Sphere of Informatisation and Telecommunications under the Ministry of Digital Technologies “Uzkomnazorat” on 04.12.2024), as well as the mass medium “HILL Media House” (registration number as a mass medium in the territory of the Republic of Uzbekistan - 1721112, issued by the Inspectorate for Control in the Sphere of Informatisation and Telecommunications under the Ministry of Digital Technologies “Uzkomnazorat” on 23.06.2026).

    1.2. “Terms of Use” - these terms of use, including their integral parts

    1.3. “Administration” - ABBA GLOBAL LLC, the owner of the Site and the founder (publisher) of the mass media outlets “HILL” and “HILL Media House”. Address: Sofdil Street, “Tashkent INDEX” shopping centre, Tashkent; TIN: 311 413 563.

    1.4. “HILL Magazine” - the periodical print publication “HILL”, published and distributed both in a printed version (Printed issue) and in an electronic format (Electronic issue).

    1.5. “User” - an individual with legal capacity, as well as a sole trader or a legal entity, that has begun using the Site.

    1.6. “Materials” - any results of intellectual activity and other objects protected by law that are published on the Site or made available through the Site, including but not limited to: text materials, articles, interviews, publications, electronic versions (issues) of HILL Magazine, photographs, images, illustrations, graphic materials, infographics, audio and video materials, podcasts, audio recordings, musical works, video clips and other audiovisual works, logos, trademarks and other means of individualisation, the design and design elements of the Site, user interface elements, selections and systematised collections of materials, and other objects of copyright, related and other intellectual rights, regardless of the presence or absence of designations, notices or other marks indicating their legal protection.

    1.7. “Electronic issue” - the electronic version of an individual issue of HILL Magazine, provided to the User for viewing and/or downloading on the terms of these Terms of Use.

    1.8. “Printed issue” - a physical copy of an individual issue of HILL Magazine, purchased by the User through the Site with subsequent delivery.

    1.9. “Subscription” - a paid service providing access to a specific set of Materials of the Site during the paid period.

    1.10. “Personal Account” - the User’s personal section on the Site, available after registration and sign-in, intended for managing the subscription, automatic renewal, purchased Materials and electronic and printed issues, and also, in the cases provided for, for access to closed photo albums of HILL Events.

    1.11. “HILL Event” - an event organised or held by the Administration (including an offline event), participants in which may be granted access to closed photo albums.

    1.12. “Offer” - the Offer for subscriptions and services published on the Site, setting out the conditions for purchasing paid Materials, the Subscription, and electronic and printed issues.

    2. Subject matter of the Terms of Use. Acceptance of the offer

    2.1. These Terms of Use (hereinafter - the “Terms of Use”) set out the conditions and the procedure for using the Site. The use of the Site means, in addition to the direct use of the website “HILL.uz”, also the purchase of Materials and services provided through the Site, the purchase by the User of paid Materials, the Subscription, and electronic and printed issues of HILL Magazine, as well as any other use of the functionality of the Site.

    2.2. The Terms of Use constitute a public offer in accordance with articles 367 and 369 of the Civil Code of the Republic of Uzbekistan and an adhesion contract in accordance with article 360 of the Civil Code of the Republic of Uzbekistan.

    2.3. By starting to use the Site by entering it and/or using any of the functionality provided by it, or by placing (paying for) any paid service or product, the User accepts this offer, that is, fully and unconditionally accepts all the conditions of the Terms of Use in accordance with article 370 of the Civil Code of the Republic of Uzbekistan. The risk of failing to read the content and conditions of the Terms of Use rests entirely with the User. The User undertakes to stop using the Site and/or any of its functionality immediately if they do not agree to accept the conditions of these Terms of Use.

    2.4. The following documents published on the Site form an integral part of the Terms of Use:

    • Privacy and Personal Data Processing Policy;

    • Content License;

    • Offer for subscriptions and services.

      2.5. The Administration may at any time amend the Terms of Use, as well as their integral parts listed in clause 2.4 of the Terms of Use, unilaterally and without prior notice to the User. The new version of the amended document takes effect from the moment it is published on the Site at the address indicated in clause 2.4 of the Terms of Use, unless the Terms of Use themselves provide otherwise. Continuing to use the Site after the changes take effect means that the User agrees to them; if the User does not agree, they must stop using the Site.

      2.6. The conditions for purchasing, paying for and returning paid Materials, the Subscription, and electronic and printed issues are set out in the Offer. In the event of a conflict between these Terms of Use and the Offer as regards paid services and products, the conditions of the Offer prevail.

      2.7. The conditions for using the Materials, including the permitted means of reproducing, quoting and reprinting them, are set out in the Content License.

    3. Registration and the Personal Account

    3.1. Part of the Materials of the Site is available without registration. To take out a Subscription, to purchase paid Materials and electronic and printed issues, and to access the Personal Account, the User completes registration.

    3.2. Registration is voluntary and free of charge. When registering, the User provides an email address and/or telephone number, a name and a password, and undertakes to provide accurate, complete and up-to-date information. The User must complete the email address confirmation process by following the link in the message received at the email address provided at registration from the Administration’s official email address info@hillmagazine.ru.

    3.3. Upon completion of registration, a User account is created and access to the Personal Account is opened. The account details are the means by which the User signs in to the Personal Account. The authentication details are the combination of the email address/telephone number and the password set by the User.

    3.4. The following are available to the User in the Personal Account:

    • management of the Subscription and automatic renewal;

    • purchased Materials and Electronic issues;

    • orders for Printed issues and their delivery status;

    • closed photo albums of HILL Events - in the cases provided for by section 5 of the Terms of Use.

      3.5. The User may not transfer their account details to third parties and is responsible for keeping them safe. Any actions performed using the User’s authentication details are deemed to have been performed by the User themselves, unless proven otherwise. The User undertakes to notify the Administration immediately of any unauthorised access to the account or any compromise of the access details at info@hillmagazine.ru.

      3.6. The Administration may block or delete the User’s account if inaccurate data is provided or if the User breaches the conditions of the Terms of Use. The deletion of an account means that the User loses access to the Personal Account. The Administration is not liable for losses and loss of information connected with the blocking or deletion of an account, except for the consequences in respect of services and products paid for by the User (including a current Subscription and unfulfilled orders for Printed issues), which are determined by the Offer.

      3.7. The User may at any time delete their account independently through the functionality of the Personal Account. Where an account is deleted at the User’s initiative:

      3.7.1. the current Subscription terminates early, and the funds for the paid but unused period are non-refundable, unless the Offer provides otherwise;

      3.7.2. the automatic renewal of the Subscription is terminated;

      3.7.3. access to separately purchased Electronic issues and other one-off Materials provided through the Personal Account terminates together with the closure of the account; the User is advised to save (download) such Materials in advance, where the functionality of the Site provides for the possibility of downloading them;

      3.7.4. the order history, including orders for Printed issues, becomes unavailable to the User;

      3.7.5. the Administration ceases processing the User’s personal data, except for data that the Administration is obliged or entitled to store in accordance with the legislation of the Republic of Uzbekistan (including accounting and tax records and information on payments made and orders fulfilled), for the periods established by law.

    4. Materials and services of the Site

    4.1. The Site publishes editorial materials, interviews, articles, special projects and electronic versions of HILL Magazine. Part of the Materials is provided free of charge, part - under a Subscription or for a separate fee (one-off purchase).

    4.2. The composition, price and access period for paid Materials and the Subscription are set out in the Offer and in the interface of the relevant sections of the Site. Before making a purchase, the User must read the conditions of the Offer.

    4.3. The Administration may at any time expand, restrict and change the list of both free and paid Materials and services, as well as their price and the design of the Site, at its own discretion.

    4.4. Access to paid-for Electronic issues and one-off Materials is provided through the Personal Account on the terms of the Offer.

    4.5. The Subscription provides the User with access to a specific set of Materials during the paid period and does not constitute the acquisition of a specific list of Materials for permanent use. The composition of the Materials available under the Subscription may change: individual articles, videos and other Materials may be added, updated, archived, deleted or become unavailable at the discretion of the Administration or at the request of rightsholders. Such changes do not constitute improper provision of the service.

    4.6. A separately purchased (one-off paid) Electronic issue is provided to the User for the period [TO BE SPECIFIED: indefinitely / for the term of the account / another period] determined by the Offer. The conditions of access to Materials purchased on a one-off basis are determined by the Offer, taking into account the provisions of section 3 of the Terms of Use on the consequences of deleting an account.

    4.7. The Materials of the Site are of an informational and editorial nature. The Materials do not constitute and do not replace individual legal, investment, financial, medical, tax or other professional advice. Any decisions taken on the basis of the Materials are taken by the User independently and at their own risk; for individual recommendations, the User should contact the relevant qualified specialists.

    4.8. The publication of user posts and comments on the Site is not provided for. There is no self-service advertising account on the Site.

    5. Closed photo albums of HILL Events

    5.1. Participants in HILL Events may be granted access, through the Personal Account, to closed photo albums of the relevant Events. The procedure for and the period of granting such access are determined by the Administration.

    5.2. The Materials of closed photo albums are provided for the personal non-commercial use of the participant in the Event. The User may not reproduce, distribute, publish or otherwise transfer the photographs to third parties without the consent of the Administration, except for photographs featuring the User’s own image, unless otherwise agreed with the Administration in writing.

    5.3. Photo albums may contain images of other participants in the Event. When using a photo album, the User undertakes to respect the rights of third parties to the protection of their image and not to allow the photographs to be used in a manner that infringes the rights and legitimate interests of the persons depicted.

    5.4. The User gives the Administration their full and unconditional consent to the use of their likeness (image), as well as of photo and video materials featuring them created during HILL Events, including:

    • by granting access to such materials to other Users in a manner similar to that in which materials from the Event are provided to the User themselves;

    • for publication in HILL Magazine (in the printed and electronic versions);

    • for publication in the official accounts and pages of the Administration on social networks and messengers;

    • for advertising and marketing purposes, including in the creation of advertising materials.

      5.5. The consent is given without any limitation as to the territory of use and for the entire term of the exclusive rights to the relevant materials, free of charge, unless otherwise agreed by the Parties. This consent does not extend to the use of the likeness in a manner that defames the honour, dignity and business reputation of the User.

      5.6. The holding of an Event, as well as the conditions of participation in an Event, are governed by a separate document adopted and published by the Administration.

    6. Rights and obligations of the User

    6.1. The User undertakes to comply with the legislation of the Republic of Uzbekistan and the conditions of these Terms of Use, to keep their data up to date, not to impersonate another person and not to disrupt the normal operation of the Site.

    6.2. The User undertakes to use the Materials solely within the functionality of the Site and for personal non-commercial use.

    6.3. The User may not reproduce, distribute, publish or transfer to third parties Materials to which access is granted under a Subscription or for a fee, except in the cases expressly provided for by law and by the Content License.

    6.4. When using the Site, the User is prohibited from:

    • circumventing or attempting to circumvent technical measures restricting access to paid Materials (paywall);
    • granting paid access to third parties, including by transferring account details or Subscription access to them;
    • carrying out bulk downloading, copying or collection of Materials;
    • using bots, parsers, automated data collection programs (scraping) and other automated means to access the Site and the Materials;
    • performing actions that disrupt or threaten to disrupt the normal operation, security and availability of the Site for other Users;
    • obtaining or attempting to obtain access to another User’s Personal Account;
    • circumventing territorial, technical and other access restrictions established by the Administration.

    7. Rights and obligations of the Administration

    7.1. The Administration undertakes to provide the User with paid-for access to the Materials and services in accordance with the conditions of the Terms of Use and to respond to the User’s enquiries submitted in accordance with the procedure established by these Terms of Use within a reasonable time.

    7.2. The Administration may:

    • change the composition, design, functionality and price of the Materials and services of the Site;
    • independently determine the content of HILL Magazine;
    • independently determine the dates, conditions, format, topics, participants, guests, etc. of HILL Events;
    • temporarily or fully restrict the User’s access to the Site or block (delete) the account in the event of a breach of the conditions of the Terms of Use or of the requirements of the law;
    • run promotions that temporarily change the price and conditions of the provision of services;
    • use the User’s personal data on the terms of the Privacy Policy and the Consent to the Processing of Personal Data;
    • send the User service notifications and, where the User has given consent, advertising and information messages; consent may be withdrawn by the User at any time.

    7.3. Where the User breaches the conditions of the Terms of Use and this results in the termination of the provision of a paid service, the price of the services not actually provided is non-refundable.

    8. Notifications and electronic interaction

    8.1. The Administration may send the User legally significant and service-related messages connected with the use of the Site to their email address or telephone number, through the Personal Account and/or by other means of communication indicated by the User.

    8.2. Such messages are sent, in particular, in connection with:

    • taking out and changing the Subscription;

    • payment and refunds;

    • automatic renewal of the Subscription;

    • password recovery and access to the account;

    • changes to the conditions of the Terms of Use and their integral parts;

    • the fulfilment and delivery of orders;

    • the blocking or deletion of the account.

      8.3. Messages are deemed received by the User from the moment they are sent to the contact details indicated by the User when registering the Personal Account. The User must keep their contact details up to date and independently bears the risk of the consequences of their being out of date or unavailable.

      8.4. From time to time, the User may be sent advertising and information messages from the Administration and/or third parties with whom the Administration has entered into the relevant contracts, to which the User agrees when using the Site. If the User does not agree to receive advertising and information messages, the User undertakes to notify the Administration of this independently. The provisions of this clause do not affect the sending of service-related and legally significant messages.

    9. Third-party services and resources

    9.1. When the Site is used, third-party services and resources may be involved, including payment systems, delivery services, embedded video players, mapping services, social networks, and external links to third-party resources.

    9.2. The use of third-party services and resources may be governed by the rules and policies of the relevant third parties. By going to a third-party resource or using a third-party service, the User independently accepts the relevant rules.

    9.3. The Administration does not manage third-party resources and services, does not control their content and is not liable for their operation or availability, nor for the processing of the User’s data by such persons, except in the cases expressly provided for by the legislation of the Republic of Uzbekistan.

    10. Intellectual property

    10.1. All Materials, as the result of intellectual activity, are subject to the exclusive rights of the Administration and/or other rightsholders from whom the Administration has obtained the relevant rights, and are protected by the legislation of the Republic of Uzbekistan.

    10.2. The use of the Materials is permitted only within the functionality of the Site and the conditions of these Terms of Use. Without the prior written permission of the rightsholder, the Materials may not be copied, downloaded, adapted, distributed or otherwise used, except in the cases expressly provided for by law and by the Content License.

    10.3. Nothing in the Terms of Use grants the User the right to use the company name, the “HILL” trademark, the domain name or other means of individualisation of the Administration.

    11. Personal data

    11.1. The User’s personal data is processed in accordance with the Law of the Republic of Uzbekistan “On Personal Data” (No. ZRU-547 of 2 July 2019) and on the terms of the Privacy Policy and the Consent to the Processing of Personal Data.

    11.2. By starting to use the Site, the User gives the Administration consent to the processing of their personal data for the purposes of providing access to the Materials and services, fulfilling orders (including the delivery of Printed issues), recording settlements and ensuring the security of the account.

    11.3. The Administration takes the necessary legal, organisational and technical measures to protect the User’s personal data and ensures that it is processed taking into account the requirements for storing the data of citizens of the Republic of Uzbekistan established by law.

    11.4. The User may withdraw consent to the processing of personal data by sending a notification to info@hillmagazine.ru. The withdrawal of consent does not extend to data that the Administration is obliged or entitled to store by virtue of the law (including accounting and tax records).

    12. No warranties and limitation of liability

    12.1. The Site and its services are provided on an “as is” basis. The Administration does not warrant that the services of the Site will meet the User’s subjective expectations or that access will be provided continuously, quickly and without errors.

    12.2. The User uses the Site and the Materials at their own risk. The Administration is not liable for indirect losses and lost profit, nor for failures caused by the operation of telecommunications networks or by the actions of malicious software or third parties.

    13. Final provisions

    13.1. These Terms of Use are governed by and construed in accordance with the legislation of the Republic of Uzbekistan. Matters not governed by the Terms of Use are resolved in accordance with the legislation of the Republic of Uzbekistan.

    13.2. The complaint (pre-trial) procedure for settling disputes is mandatory. The period for responding to a complaint is 15 (fifteen) business days. If a dispute cannot be settled through negotiations, it is subject to consideration in the manner established by the legislation of the Republic of Uzbekistan.

    13.3. If a court holds an individual provision of the Terms of Use invalid, this does not render the remaining provisions invalid.

    13.4. The Terms of Use are drawn up in the Uzbek, Russian and English languages. In the event of discrepancies between the versions, the Russian version prevails, unless otherwise required by the mandatory requirements of the legislation of the Republic of Uzbekistan.
