    1. General provisions. Terms and definitions

    1.1. This Content License (hereinafter - the “License”) sets out the terms and the procedure for using the Materials published on the Site at https://hill.uz or made available through the Site, as well as the conditions for the free (gratuitous) use of individual Materials and the rules for citing the source.

    1.2. The License forms an integral part of the HILL.uz Terms of Use (hereinafter - the “Terms of Use”) in accordance with clause 2.4 of the Terms of Use. Terms used in the License with a capital letter and not defined herein (including “Site”, “Administration”, “Materials”, “HILL Magazine”, “Electronic issue”, “Printed issue”, “Subscription”, “User”) have the meanings given to them in the Terms of Use.

    1.3. In the event of a conflict between the License and the Terms of Use as regards the use of Materials, the provisions of the License prevail. As regards the purchase, payment for and refund of paid Materials, the Subscription, and electronic and printed issues, the terms of the Offer prevail.

    1.4. The following terms are also used for the purposes of the License:

    1.4.1. “Use of Materials” - any reproduction, copying, downloading, distribution, communication to the public, public display, public performance, broadcasting or transmission by cable, translation or adaptation of Materials, as well as other means of use provided for by the legislation of the Republic of Uzbekistan, regardless of whether the relevant actions are performed for profit and of whether the use is full or partial.

    1.4.2. “Free use” - the use of individual Materials without the prior written permission of the Administration and without payment of remuneration, in the cases expressly provided for by section 4 of the License and by the legislation of the Republic of Uzbekistan.

    1.4.3. “Source attribution” - the mandatory identification of HILL as the source of the borrowing, made in accordance with section 6 of the License.

    1.4.4. “Hyperlink” - an active link, indexable by search engines, to the page of the Site where the relevant Material is published.

    1.5. The License has been developed in accordance with the legislation of the Republic of Uzbekistan, including the Civil Code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan “On Copyright and Related Rights” (No. ZRU-42 of 20 July 2006, as amended).

    1.6. The terms of this License apply to the Use of Materials by individuals as well as by sole traders and legal entities.

    2. Rights to the Materials and the scope of protection

    2.1. All Materials, as the results of intellectual activity, are subject to the exclusive rights of the Administration and/or other rightsholders from whom the Administration has obtained the relevant rights, and are protected by the legislation of the Republic of Uzbekistan. The rightsholder of the Materials is the Administration, unless otherwise indicated in respect of a particular Material or unless such Material is accompanied by an indication of another rightsholder, author or source of the borrowing.

    2.2. The absence of a copyright notice, a protection notice or any other mark next to a Material does not mean that such Material is unprotected and may be freely used without obtaining the prior written consent of the Administration, unless the License expressly provides otherwise.

    2.3. All rights not expressly granted to the User by the License, the Terms of Use or the legislation of the Republic of Uzbekistan are reserved to the Administration and/or other rightsholders. Granting the User access to the Materials (including under a Subscription or for a fee) does not transfer any exclusive rights to the Materials to the User.

    3. General terms of use of the Materials

    3.1. The User may use the Materials solely within the functionality of the Site and for personal non-commercial use, unless otherwise expressly provided by the License, by a separate written permission of the Administration or by a contract concluded with the Administration.

    3.2. Except in the cases of Free use provided for by section 4 of the License and in other cases expressly provided for by the legislation of the Republic of Uzbekistan, any Use of Materials without the prior written permission of the Administration (the rightsholder) or without concluding the relevant contract is not permitted.

    3.3. Materials to which access is granted under a Subscription or for a separate fee (including Electronic issues) are provided to the User for personal viewing and may not be reproduced, copied, distributed, published or transferred to third parties, except in the cases expressly provided for by the legislation of the Republic of Uzbekistan. When using such Materials, the User additionally complies with the prohibitions set out in section 6 of the Terms of Use (including the prohibition on circumventing technical access restriction measures (paywall), the prohibition on granting paid access to third parties, and the prohibition on bulk downloading and automated collection of Materials).

    3.4. The use of Materials from closed photo albums of HILL Events is governed by section 5 of the Terms of Use. The provisions of the License apply to such Materials to the extent that they do not conflict with section 5 of the Terms of Use.

    4. Free use of the Materials

    4.1. Subject to the terms of the License and within the scope of the functionality provided by the Site, Free use of the Materials is permitted in the form of quotation - in the original and in translation, for informational, scientific, research, polemical, critical and educational purposes, from lawfully published Materials, to the extent justified by the purpose of the quotation.

    4.2. Free use is permitted subject to the simultaneous compliance with all of the following conditions:

    4.2.1. the use is non-commercial in nature (it is not connected with deriving profit from the sale of the Material or of a product containing it, with granting paid access to it, or with placing it on resources monetised through the display of advertising - except in cases separately agreed with the Administration);

    4.2.2. the Material is used without adaptation, preserving its meaning, accuracy and reliability (clauses 6 and 7 of the License);

    4.2.3. Source attribution is provided in accordance with section 6 of the License;

    4.2.4. the prohibitions set out in section 7 of the License are not violated.

    4.3. The volume of quotation must not exceed the volume justified by the purpose of the quotation and must in any event not exceed the volume of the individual Text material being quoted. Quotation must not replace reading the Material on the Site or enable the User or third parties to do without visiting the Site.

    4.4. Free use does not apply to:

    4.4.1. Electronic issues and Printed issues of HILL Magazine, and to selections and systematised collections of Materials;

    4.4.2. photographs, images, illustrations, graphic materials and infographics;

    4.4.3. audio, video and other audiovisual works, podcasts, audio recordings and musical works;

    4.4.4. the design, the design elements of the Site and the user interface elements;

    4.4.5. logos, trademarks and other means of individualisation;

    4.4.6. Materials to which access is granted under a Subscription or for a fee;

    4.4.7. Materials in respect of which another rightsholder, author or source of the borrowing is indicated.

    The use of the listed Materials is permitted only on the basis of the prior written permission of the Administration (the rightsholder) or of a concluded contract (section 8 of the License).

    4.5. Free use is not permitted in respect of Materials to which access was obtained by circumventing technical access restriction measures (paywall) or in any other manner that violates the Terms of Use.

    5. Use of the Materials for a fee and by permission

    5.1. The use of Materials in ways and in cases going beyond section 4 of the License, including for commercial purposes, as well as the use of the Materials listed in clause 4.4 of the License, is permitted only on the basis of the prior written permission of the Administration or of a paid contract concluded with the Administration.

    5.2. The possibility of and conditions for adapting the Materials, the scope and means of use, the term and the territory are agreed between the Parties when the permission is issued or the contract is concluded.

    6. Rules for citing the source (attribution)

    6.1. In any Use of the Materials, the User must provide Source attribution as follows:

    6.1.1. In printed publications and other forms on tangible media - as a textual notice at the place of use: “Source: HILL” or “Source: HILL magazine”;

    6.1.2. In radio, television, video and other broadcasts - as an oral or visual mention: “HILL” or “HILL magazine”;

    6.1.3. On websites on the Internet and in other electronic forms - by indicating the name “HILL” as the source of the borrowing in the form of a Hyperlink to the page of the Site where the relevant Material is published (subject to additional agreement with the Administration - to the home page of the Site).

    6.2. The Source attribution is placed at the beginning of the reproduced Material. The font size of the Source attribution must not be smaller than the font size of the main text in which the Material is used.

    6.3. The Hyperlink must meet the following requirements:

    6.3.1. it must be contained in the source code of the page on which the Material used is published;

    6.3.2. it must be enclosed in an tag with the address in the href attribute; (c) it must not contain the nofollow and noindex parameters in the rel attribute of the tag and must not otherwise restrict its indexing by search engines.

    6.4. When using Materials obtained from secondary sources that contain a reference to HILL as the source, the User must provide a reference to the original source in the manner established by the License and must independently verify the original Material published on the Site.

    7. Prohibited means and cases of use

    7.1. In the case of Free use of the Materials, their adaptation is not permitted. The User undertakes to observe accuracy and reliability when reproducing the Materials. The User bears responsibility for any distortion of the content.

    7.2. In all cases, the Use of Materials is prohibited:

    7.2.1. with an indication of a publication time identical to or earlier than the time at which the relevant Material was published on the Site;

    7.2.2. in publications, on resources and on websites containing information the distribution of which is prohibited within the territory of the Republic of Uzbekistan, or in a manner that violates the legislation of the Republic of Uzbekistan;

    7.2.3. for purposes that undermine the business reputation of the Administration, HILL Magazine and/or third parties or that defame their honour and dignity, or that cause them other harm;

    7.2.4. in a manner that creates a false impression among third parties that the User has a relationship with the Administration, that the Administration endorses the User’s use, views or content, or that otherwise creates an association with the HILL brand that does not correspond to reality;

    7.2.5. in other cases where such Use causes or may cause harm to the legally protected interests of the Administration and/or the rightsholders.

    7.3. Nothing in the License grants the User the right to use the company name, the “HILL” trademark, the domain name or other means of individualisation of the Administration, other than the indication of HILL as the source expressly provided for by the License.

    7.4. The use of bots, parsers and other automated means to access, extract, copy and distribute the Materials is prohibited, as are other actions prohibited by section 6 of the Terms of Use.

    8. Obtaining permission. Concluding a contract

    8.1. To obtain written permission to use the Materials in ways going beyond Free use, and to conclude a contract on the use of the Materials for a fee, the User contacts the Administration at info@hillmagazine.ru or using other contact details indicated on the Site.

    8.2. The price, scope, term, territory and other conditions of use of the Materials are determined by agreement of the Parties.

    9. Liability

    9.1. The use of the Materials in breach of any of the provisions of the License means that they are used without the permission of the Administration (the rightsholder), which constitutes an infringement of exclusive rights and entails civil, administrative, criminal and other liability provided for by the legislation of the Republic of Uzbekistan.

    9.2. The User shall compensate the Administration for losses caused as a result of claims, demands or lawsuits brought against the Administration by third parties whose rights have been infringed by the User’s unlawful actions, and as a result of acts of authorised state bodies issued against the Administration and caused by such actions.

    10. Amendments to the License. Final provisions

    10.1. The Administration may at any time, unilaterally and without prior notice to the User, amend the License in the manner provided for by clause 2.5 of the Terms of Use. The new version takes effect from the moment it is published on the Site, unless the License itself provides otherwise. Continuing to Use the Materials after the changes take effect means that the User agrees to them.

    10.2. If an individual provision of the License is held invalid, this does not render the remaining provisions invalid.

    10.3. The License is drawn up in the Uzbek, Russian and English languages. In the event of discrepancies between the versions, the Russian version prevails, unless otherwise required by the mandatory requirements of the legislation of the Republic of Uzbekistan.

    10.4. In all matters not governed by the License, the provisions of the Terms of Use and the legislation of the Republic of Uzbekistan apply.
